Employee Fired After Criticizing LGBT Pride Promotion

Transgender people have additional difficulties in the job. LGBTQ+ rights at work in the United States have made progress, including an executive order issued by President Biden in January that implemented a landmark Supreme Court rule that protected LGBTQ+ persons from employment discrimination.

Arconic dismissed an employee for opposing LGBT pride month, according to a complaint.

Daniel Snyder, a former Davenport Works employee in Riverdale, Iowa, is represented by the Thomas More Society. Arconic, which operates Davenport Works, fired Snyder in 2021.

The complaint alleges Arconic fired Snyder after he insulted LGBT pride month in an intranet message.

Snyder felt he was responding to an anonymous corporate poll when he termed the corporation’s usage of the rainbow to promote LGBT pride “an affront to God.”

“A coworker was insulted.”

On Wednesday, Thomas More Society filed the case in the Southern District of Iowa, characterizing the longstanding employee’s firing as unconstitutional religious discrimination. Snyder’s complaint comes 90 days after receiving the EEOC’s right-to-sue letter.

The complaint states that Mr. Snyder was suspended and subsequently fired for breaching the company’s diversity policy. Before his firing, Mr. Snyder told Arconic that he made his comment based on his Christian values, that he had intended to answer the anonymous survey (he was met with scornful laughter), and that he would never ‘offer his opinion to their solicitations again.’

Arconic declined to comment on Snyder’s case. Unexpected answer.

The lawsuit questioned Arconic’s “diversity policy,” stating that it only allowed workers to speak “the company’s accepted narrative on morally loaded matters — while considering any employee’s religious opposition as grounds for swift termination with no accommodation.”

Arconic’s “diversity policy” prohibits discrimination, intimidation, harassment, and retribution.

The complaint called the company’s “zero tolerance,” “diversity policy,” and “intolerance” violates Title VII of the Civil Rights Act, which prohibits religious discrimination.

Thomas More Society alleges Arconic’s rules are “intended to exclude… anybody who dissents from its corporate moral ideas.”

“Under Title VII, ‘religion’ covers all aspects of religious observation and practice, as well as belief, unless an employer establishes he can’t fairly accommodate an employee’s or prospective employee’s religious observance or practice without undue hardship,” the lawsuit states.

The lawsuit seeks to reverse Snydyer’s firing and recover back salary, damages, and attorney expenses.

Snyder wants the corporation to require employees to respect each other’s religions.

Snyder, now 63, joined John Deere after being fired. His new work pays less than Arconic and forces him to stand much of the time. His advanced position at Arconic allowed him to handle substantial responsibilities from his office, which suited his age.

Snyder hasn’t worked overtime at John Deere, but he did at Arconic. John Deere’s medical benefits aren’t as good as Arconic’s.

Wednesday’s lawsuit followed a failed appeal to the Iowa Civil Rights Commission.

“Arconic’s conduct violated Mr. Snyder’s right to be free from employment discrimination,” stated Thomas More Society Counsel Michael McHale. “His short web survey response was religiously plain.

“Arconic took no attempt to accommodate Mr. Snyder’s religious convictions, even if it was a one-time comment,” McHale said.

Snyder’s attorney said he “respects all persons regardless of sexuality” and “worked with a transgender person at Arconic without incident.”

Efforts may encounter difficulties. Furthermore, some businesses place a higher value on fostering a diverse workforce regarding sexual orientation than they do on employees’ freedom to express their gender. It is all too common for companies to overlook the transgender experience when it comes to business diversity, equity, and inclusion.
