Parents Carlos Gordoa and Ariani Reyes and their son, B.G., filed a complaint Monday in federal court in San Jose, California, claiming that the AirPods are faulty because they broadcast notifications at unsafe volume, regardless of the book set by the user. Their accusations of extreme carelessness and fraud were met with skepticism.
Despite a request for comment, Apple did not answer promptly.
When B.G., then 12, was watching Netflix on his iPhone while wearing an AirPod attached to the phone in his right ear, the complaint claims that the damage occurred in May 2020, according to the lawsuit.
After receiving an Amber Alert concerning a missing or abducted child, the family claims the sound level was so loud that it ruptured B.G.’s eardrum and caused damage to his inner ears. According to the complaint, B.G. has permanent hearing loss and tinnitus, suffers from dizziness, and needs to wear a hearing aid.
They said Apple was aware that its AirPods were playing unusually loud notifications from online complaints dating back to 2019 by customers who observed that the loudness of alerts did not match the volume of material they were playing.
According to the family’s lawyer, “Apple failed to issue a warning regarding the volume levels of its AirPods, resulting in his irreversible hearing loss,” Tej Paranjpe said in a statement.
